1. Agreement and service provider
These Terms of Service (Terms) govern your access to the Qubeforms website, form endpoints, APIs, dashboard, and related services (the Service). Qubeforms is operated and billed by Qubus Labs, LLC. References to "we", "us", and "our" mean Qubus Labs, LLC. By creating an account or using the Service, you agree to these Terms. If you do not agree, you must not use the Service. If you use Qubeforms on behalf of an organization, you represent that you have authority to bind that organization, and references to "you" mean that organization. A separate agreement signed with Qubus Labs, LLC controls over these Terms where they conflict.
2. Accounts and account security
You must be legally able to enter into this agreement and provide accurate, current account and billing information. You are responsible for activity under your account, the people you authorize to access it, and the security of your credentials, API keys, and integrations. Notify us promptly if you suspect unauthorized access or a compromised credential. Only share access through the account and team features available on your plan.
3. Permission to use Qubeforms
Subject to these Terms and your plan limits, we grant you a limited, non-exclusive, non-transferable right to use the Service for your personal or business forms and workflows. This permission does not transfer ownership of the Service or our intellectual property. Except where applicable law permits otherwise, you may not copy or resell the Service, reverse engineer its proprietary software, remove proprietary notices, or use another person's account or credentials without authorization. Separately licensed components remain subject to their own licenses.
4. Acceptable use
Use Qubeforms only for lawful purposes. You must not use it for spam or unsolicited bulk messages, phishing, fraud, harassment, malware, unlawful content, or infringement of another person's rights. Do not attempt unauthorized access, bypass quotas or security controls, probe other customers' data, or disrupt the Service. Do not collect passwords, full payment-card details, or sensitive health or other regulated information unless we have expressly agreed in writing to support that use and any required safeguards. Security research should follow our responsible disclosure policy.
5. Your forms and submissions
You are responsible for your forms, uploaded files, submission content, recipient permissions, and destinations such as email addresses and webhooks. You must have the rights and lawful basis needed to collect and process the data you send through Qubeforms, provide appropriate privacy notices, and obtain consent where required. You retain ownership of your content and grant Qubus Labs, LLC permission to host, process, transmit, and display it only as needed to provide, secure, and support the Service or comply with law. You are responsible for responding to requests from the people who submit data to your forms.
6. Privacy and data processing
Our Privacy Policy describes how account information and form submissions are handled. We use submission data to operate and secure the Service, including storage, routing, and delivery, and do not sell personal data or use submission contents for advertising. Where you determine the purposes and means of processing personal data collected through your forms, you are responsible for your obligations as a data controller. If your use requires a data processing agreement or other specific contractual safeguards, contact us to arrange them before submitting that data. These Terms do not replace any legally required data processing agreement.
7. Storage, attachments, and retention
Submission and attachment storage is subject to your plan and the retention settings available for your forms. Free-plan submissions have a maximum retention period of 30 days; paid-plan retention follows the applicable plan and settings. Uploads, where included, use private object storage with time-limited access links. Records and associated files may be deleted when their retention period expires or when you delete them. Backups and operational records may follow separate limited retention schedules as described in our Privacy Policy. Export and retain any records you need before they expire or you close your account. Deleting a Qubeforms record does not remove copies already delivered to your email, webhooks, or other destinations.
8. Plans, fees, and payments
Free and paid plans are subject to the features, allowances, and limits described on the plans page and at checkout. Qubus Labs, LLC is the entity that charges and bills you for Qubeforms. Payment providers process transactions on our behalf. Your checkout and billing records identify the applicable price, currency, billing interval, and taxes. You authorize Qubus Labs, LLC and its payment providers to charge your selected payment method for the purchases and subscriptions you approve. Keep your payment information current. Failed or overdue payments may result in restricted access or suspension, with notice when practicable.
9. Renewals, cancellation, and refunds
If you choose a recurring subscription, it renews at the billing interval and price disclosed at checkout until you cancel. Manage your subscription through the billing portal linked from your account, or contact billing@qubeforms.com for help with cancellation. Cancel before the next renewal to stop future recurring charges. The effective date of plan changes or cancellation, any remaining access, and any credits or refunds follow the terms disclosed when you purchase or change your plan and any rights provided by applicable law. We will give advance notice of changes to recurring prices before they take effect so you can cancel before being charged the new price. Stopping use of your forms does not itself cancel a paid subscription.
10. Support
Contact support@qubeforms.com for help with the Service and billing@qubeforms.com for payment or subscription questions. Include a description of the issue and relevant form or request identifiers, but do not send passwords, API secrets, payment-card details, or unnecessary personal data. We aim to respond promptly, but no specific response or resolution time is guaranteed unless agreed separately in writing.
11. Third-party services and links
Qubeforms may connect to payment providers, storage and email services, CAPTCHA providers, and destinations you configure. Your use of third-party websites and services may be subject to their own terms and privacy policies. Links do not imply our endorsement. We do not control third-party services and cannot guarantee their availability or behavior. You are responsible for selecting and configuring your integrations and reviewing their terms.
12. Availability and service changes
We work to keep Qubeforms reliable, but maintenance, network failures, third-party outages, and other events may interrupt access or delivery. Spam filtering may reject legitimate submissions or allow unwanted submissions through; delivery to an external inbox or system is not guaranteed. We may update features, documentation, and limits to improve the Service, address security concerns, or comply with law. We will provide reasonable advance notice of material reductions to a paid service or a planned shutdown when practicable, allowing an opportunity to export data. No specific uptime or service-level commitment applies unless agreed in writing.
13. Suspension and termination
You may stop using Qubeforms and request account closure at any time; cancel any paid subscription as described above. We may suspend or terminate access for a material breach of these Terms, non-payment, unlawful activity, or a risk to customers or the Service. Where practicable, we will explain the reason and give you an opportunity to resolve it. Immediate action may be necessary to prevent harm or comply with law. When access ends, your permission to use the Service ends and data remains subject to applicable retention and deletion rules. Payment obligations already incurred and provisions that by their nature should survive termination remain in effect.
14. Disclaimer of warranties
To the fullest extent permitted by applicable law, the Service and website materials are provided as is and as available. Qubus Labs, LLC disclaims implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, completely secure, or suitable for every intended use, or that website materials will always be accurate, complete, or current. Nothing in these Terms excludes warranties or other rights that cannot lawfully be excluded.
15. Limitations of liability
To the fullest extent permitted by applicable law, Qubus Labs, LLC and its service providers will not be liable for indirect, incidental, special, or consequential damages, or loss of profits, revenue, business opportunities, or data arising from your use of or inability to use the Service, even if advised of the possibility of those losses. These limitations apply only where lawful. Nothing in these Terms excludes or limits liability for fraud, willful misconduct, or any other liability that applicable law does not allow us to exclude or limit.
16. Changes to these Terms
We may revise these Terms and will update the date shown on this page. For material changes, we will provide reasonable advance notice through the Service or your account email, except where an urgent legal or security reason requires a change sooner. Changes apply from the effective date stated in the notice. If you disagree with revised Terms, stop using the Service and cancel any paid subscription before they take effect. Continued use after the effective date constitutes acceptance to the extent permitted by applicable law.
17. General provisions
These Terms and any applicable purchase terms or signed agreement form the agreement between you and Qubus Labs, LLC for the Service. If a provision is found unenforceable, the remaining provisions remain in effect. A failure to enforce a provision is not a waiver of the right to enforce it later. Nothing in these Terms removes mandatory consumer protections, statutory refund rights, or your right to bring a claim in a court where applicable law permits. Please contact us first if you have a concern so we can try to resolve it.
